§1 General provisions
- The website www.atribu-welding.com operates on the terms set out in these Terms and Conditions.
- These Terms and Conditions define the conditions for concluding and terminating Product Sales Agreements and the complaint-handling procedure, as well as the types and scope of services provided electronically by the Store.
- Every Service Recipient is obliged to comply with the provisions of these Terms and Conditions from the moment they begin using the Store's Electronic Services.
- In matters not regulated herein, the following shall apply: the Polish Act on Providing Services by Electronic Means of 18 July 2002, the Polish Act on Consumer Rights of 30 May 2014, the Polish Act on Out-of-Court Resolution of Consumer Disputes of 23 September 2016, the Polish Civil Code of 23 April 1964, and other applicable provisions of Polish law.
§2 Definitions
- TERMS AND CONDITIONS – these Terms and Conditions of the Store.
- STORE – the Service Provider's online store located at www.atribu-welding.com.
- ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Store.
- ORDER FORM – the form on the Store's website enabling an Order to be placed.
- SELLER, SERVICE PROVIDER – ATRIBU S.C., ul. Dworcowa 15a, 42-140 Panki, NIP: 5742077957, e-mail: stoly@atribu.pl, tel.: +48 694 114 164.
- SERVICE RECIPIENT – a natural person, legal person, or organizational unit without legal personality, using an Electronic Service.
- CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
- CONSUMER – a natural person entering into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- ENTREPRENEUR – a natural person, legal person, or organizational unit conducting business or professional activity in its own name.
- PRODUCT – a movable item or service available in the Store that is the subject of a Sales Agreement.
- SALES AGREEMENT – a Product Sales Agreement concluded between the Customer and the Seller via the Store.
- ORDER – a declaration of intent by the Customer constituting an offer to conclude a Sales Agreement.
- PRICE – the value expressed in monetary units that the Customer is obliged to pay the Seller for the Product.
§3 Product information and ordering
- The information on the Store's website does not constitute an offer within the meaning of the law. By placing an Order, the Customer makes an offer to purchase the Product on the terms stated in its description.
- Orders can be placed: via the Order Form 24 hours a day, by e-mail at stoly@atribu.pl, or by phone at +48 694 114 164.
- Placing an Order is conditional on reading these Terms and Conditions and accepting their provisions.
§4 Conclusion of the sales agreement
- To conclude a Sales Agreement, the Customer must place an Order in one of the ways specified in §3.
- Upon placing an Order, the Seller shall promptly confirm its receipt by e-mail.
- The confirmation contains all material elements of the Order.
- The Sales Agreement between the Customer and the Seller is concluded upon receipt of the confirmation.
- Every Sales Agreement is confirmed by a proof of purchase (VAT invoice) attached to the Product or sent by e-mail.
§5 Payment methods
- The Seller offers: a traditional bank transfer, payment via an electronic payment system (Przelewy24.pl), and cash on delivery.
- For traditional bank transfer: 78 1020 1664 0000 3102 0695 4582 (PKOBP), ATRIBU S.C., ul. Dworcowa 15a, 42-140 Panki. Transfer title: "Order no. … and Surname".
- The Customer is obliged to make payment within 7 business days of the conclusion of the Sales Agreement, unless the Agreement provides otherwise.
- In the case of bank transfer or electronic payment, the Product will be shipped only after payment has been received.
§6 Delivery cost, time, and methods
- Delivery costs are determined when placing the Order and depend on the chosen payment and delivery method.
- The time required to manufacture and prepare the Products is up to 14 business days from the crediting of funds or acceptance of the Order for processing.
- Delivery by carrier takes place within 14 business days of dispatch (business days, excluding Saturdays, Sundays, and public holidays).
- Products are shipped by courier, freight forwarding company, or, by prior arrangement, own transport.
§7 Product complaints
1. Warranty complaints
- All Products offered in the Store are covered by a warranty valid within the territory of the Republic of Poland.
- The warranty period for new Products is 12 months from the date of delivery; for used items – 14 days.
- The document entitling the holder to warranty protection is the warranty card or proof of purchase.
- The warranty does not exclude the Consumer's rights arising from the Product's lack of conformity with the contract.
2. Complaints regarding lack of conformity of the Product with the contract
- The Seller is liable to the Consumer for any lack of conformity of the Product with the contract that existed at the time of delivery and is discovered within 2 years.
- Notification may be made by e-mail: stoly@atribu.pl or in writing to the address: ATRIBU S.C., ul. Dworcowa 15a, 42-140 Panki.
- The Seller shall respond to the request promptly, no later than within 30 days.
- In the case of a Consumer's complaint, failure to respond within 14 days is equivalent to acceptance of the complaint.
- The Customer may in the first instance demand replacement or repair of the Product; a price reduction or withdrawal from the contract is available in the cases specified by law.
- In justified complaints, the Seller shall cover the costs of repair/replacement and delivery.
§8 Right of withdrawal from the contract
- The Consumer (and the entity referred to in §10) may withdraw from a distance contract without giving any reason within 14 days.
- In the event of withdrawal, the Agreement is deemed not to have been concluded, and the Product must be returned within 14 days to the address: ATRIBU S.C., ul. Dworcowa 15a, 42-140 Panki.
- The Consumer is liable for any diminished value of the Product resulting from use beyond what is necessary to establish its nature.
- The Seller shall refund the value of the Product together with the delivery costs within 14 days of receiving the declaration of withdrawal.
- If the Consumer chose a delivery method other than the cheapest standard method offered, the Seller shall not reimburse the additional costs.
- The Consumer bears the cost of returning the Product to the Seller.
- The right of withdrawal does not apply in the case of: non-prefabricated goods manufactured to the Consumer's specification, goods in sealed packaging (for hygiene reasons), goods which, after delivery, are inseparably combined with other items, and services fully performed with the Consumer's consent.
§9 Provisions concerning entrepreneurs (B2B)
- The Seller has the right to withdraw from the Agreement with a Customer who is not a Consumer within 14 business days of its conclusion, without giving a reason.
- The Seller may limit the available payment methods and require prepayment of part or all of the price.
- Benefits and burdens related to the Product pass to the Customer who is not a Consumer at the moment the Product is handed over to the carrier.
- The Customer who is not a Consumer is obliged to inspect the shipment upon receipt.
§10 Provisions concerning entrepreneurs with consumer rights
- A sole proprietor is covered by the protection afforded under the Polish Act on Consumer Rights if the contract does not have a professional character for them.
- This protection covers: prohibited contractual clauses, liability for lack of conformity of the Product with the contract, the right to withdraw from a distance contract, and rules regarding contracts for the supply of digital content or digital services.
§11 Type and scope of electronic services
- The Service Provider enables the conclusion of Product Sales Agreements via the Store.
- Services are provided on the terms set out in these Terms and Conditions. The Service Provider has the right to place advertising content on the website.
§12 Conditions for providing electronic services
- The provision of Electronic Services is free of charge.
- The agreement is concluded for a definite period and is terminated when the Order is placed or when the Order process is abandoned.
- Technical requirements: a computer/device with Internet access, access to e-mail, and a web browser with Cookies and JavaScript enabled.
- The Service Recipient is obliged to use the Store in accordance with the law and good practice, and to enter data consistent with the actual facts.
§13 Complaints regarding electronic services
- Complaints may be submitted by e-mail to: stoly@atribu.pl.
- As much information as possible about the subject of the complaint should be provided.
- Complaints are handled within 14 days.
§14 Termination of agreements for the provision of electronic services
- An agreement of a continuous and indefinite nature (Account, Newsletter) may be terminated. The Service Recipient may terminate the agreement with immediate effect by e-mail to stoly@atribu.pl or by deleting the Account.
- The Service Provider may terminate the agreement in the event of a breach of these Terms and Conditions, after an unsuccessful request to remedy the breach. The agreement expires 7 days after the declaration is made.
§15 Intellectual property
All content posted on the website www.atribu-welding.com is protected by copyright and is the property of ATRIBU S.C. Any use without the express written consent of the Service Provider constitutes an infringement of copyright.
All trade names, product names, company names, and their logos used on the Store's website belong to their respective owners and are used solely for identification purposes.
§16 Liability
- The Service Provider shall make every effort to ensure that the data in the Store is complete and up to date.
- The Service Provider fulfils its obligations under the Digital Services Act (DSA) and has designated a point of contact at its registered office.
- It is prohibited to post unlawful content, content unrelated to the Store's subject matter, content that damages the Service Provider's reputation, or content promoting competing businesses.
- Reports of prohibited content can be sent to: stoly@atribu.pl.
- The Service Recipient bears full liability for any damage caused by their actions within the Store.
§17 Final provisions
- Agreements concluded through the Store are governed by Polish law.
- Disputes between the Store and Customers shall first be resolved through negotiation.
- Disputes with a Consumer are settled by the courts having jurisdiction under the Code of Civil Procedure; disputes with a Customer who is not a Consumer are settled by the court having jurisdiction over the Service Provider's registered office.
- The Consumer has the right to use out-of-court dispute resolution methods, including the ODR platform: ec.europa.eu/consumers/odr/.
